Minister of Law Supratman Andi Agtas revealed that President Prabowo Subianto has approved the repatriation of foreign nationals who are imprisoned for drug-related offenses, including those involved in the Bali Nine case. However, Supratman noted that Prabowo has requested that the process not be rushed, as there are currently no established regulations governing it.
"Regarding the Bali Nine, I reiterate that the President has fundamentally agreed to initiate the transfer process. However, we must not act hastily, as this involves procedural matters. We do not yet have the necessary rules for the general transfer mechanism," Supratman stated to reporters at the Presidential Palace Complex in Jakarta on Monday, November 25, 2024.
Supratman mentioned that they have received instructions from Prabowo to conduct a thorough study concerning the mechanism. He indicated that the process is currently in its finalization stage.
The President has emphasized to the Coordinating Minister for Legal Affairs and the Minister of Law the necessity of conducting a study, with the process now nearing finalization. We aim to accomplish this within a timeframe that may be either December or early next year, although I cannot provide a definitive timeline at this moment. Fundamentally, the President is in agreement, and we are preparing for this initiative, he stated.
Supratman underscored that any country requesting the transfer of prisoners must submit a formal letter to the Indonesian government.
"Moreover, it is not limited to that; all friendly nations with citizens who are currently inmates are required to send a letter to the Indonesian government," Supratman added.
He reiterated the conditions that must be met, stating, "Once again, the primary requirement is that they must acknowledge our legal system and the judicial processes that have already taken place."
Furthermore, Supratman revealed the considerations behind Prabowo's approval for the repatriation of foreign national prisoners, highlighting humanitarian reasons as a significant factor. Additionally, he noted the presence of Indonesian citizens abroad who are facing legal issues.
"The second point the President reminded us of is that this is primarily a humanitarian consideration. Lastly, why are we undertaking this? It is also because we have our own citizens abroad who are currently entangled in legal matters," he elaborated. (srirahayu@insightinnews.com)
