France, Australia And Philippines Request For Transfer Of Prisoners

The Minister of Immigration and Law Enforcement, Agus Andrianto, has revealed that three countries have submitted requests for the transfer of prisoners. "There is one request from France, five from Australia, and one from the Philippines," stated Agus Andrianto following a meeting with the Attorney General at the Attorney General's Office in Kebayoran Baru, South Jakarta, on Monday, November 25, 2024.


Agus Andrianto indicated that the requests from foreign nations regarding prisoner transfers were a topic of discussion during his meeting with Attorney General Sanitiar Burhanuddin and his team. The transfer of prisoners refers to the process of returning an inmate to their home country to serve the remainder of their sentence in accordance with a court ruling.


"We discussed the issue of prisoner transfers, which have been requested by several countries to the Indonesian government," Agus Andrianto noted. The Minister of Immigration and Law Enforcement explained that the repatriation of prisoners is still under government review. Furthermore, the policy regarding such repatriation is outlined in Law Number 22 of 2022 concerning Corrections.


This matter is still under discussion from a legal perspective. According to the mandate of Law Number 22 of 2022, the possibility of executing a transfer of prisoners is indeed feasible, stated Agus Andrianto. He noted that Article 2 of the Correctional Law indicates that such policies must be regulated by subordinate regulations, which have yet to be established.


"It is essential for the law to be governed by lower regulations. However, we are seeking the best possible solution. There must be a mutual agreement between the countries involved," Agus Andrianto added. "If not, when we transfer prisoners, we hope to receive similar arrangements for Indonesian citizens.
